How does mediation work?
After an initial consultation with each party, APM will schedule a virtual mediation session including both parties. If one/both parties prefer, sessions can be held in separate "rooms" so that the parties are not interfacing. Mediation sessions can be as short as an hour or up to 6+ hours/day for as long as necessary until the parties reach an agreement. The agreement is then finalized and entered into the Court record as a stipulated order.
How much does mediation cost?
While the cost is dependent on the complexity of the case, mediation is usually significantly less expensive than litigation. The average attorney hourly rates in Metro Phoenix are $250-500/hour for each party. In custody matters, the Court often appoints providers ($275-$1,000/hour), custody evaluations ($25K-50K+/report), psychological examinations, random drug testing orders, and/or forensic audits of financial records It is not uncommon for EACH party to spend $100,000 to prep 12-months for one custody hearing. And once your family is in family court, either party can field for modification of the parenting plan every 12 months. While this requires "significant change in circumstances," it is the judge's discretion what qualifies (e.g. seemingly inconsequential changes like a child's extracurricular activities can trigger another costly modification). My ex doesn't want to go to mediation. How do I convince them?
While mediation is only as successful as the willingness of the participants, there are several benefits you and your ex want to consider such as : significantly lower overall expenses, faster resolution and maintaining control over the outcome.
